Orán: Un policía la contactaba por redes sociales y luego abusó de ella. No habrá juicio abreviado
La jueza María Laura Toledo, rechazó el acuerdo de juicio abreviado que presentaron las partes en el marco de la causa que se sigue contra un hombre de 28 años que está acusado como autor de los delitos de abuso sexual con acceso carnal en perjuicio de una menor.
Tuvo en cuenta para ello el modo en que el imputado, que se desempeña como policía de la provincia, se habría contactado con la menor utilizando redes sociales como Messenger y otras vías tecnológicas, para captar a la víctima. Agregó que no comparte la calificación legal del delito por el que fue acusado el hombre, ya que el abuso sexual podría concursar con el de Grooming.
Al acuerdo se había opuesto la asesora de menores e incapaces, que actúa en representación de la joven víctima, lo que tuvo en cuenta la jueza al momento de rechazar el acuerdo que habían presentado la fiscalía y la defensa, ya que no se encontraban cumplidas las condiciones legales para hacer lugar a ello.
Agregó que resulta necesario un mayor conocimiento de los hechos para garantizar tanto los derechos de la víctima como del imputado.
La jueza ordenó la destrucción del incidente, y que el expediente sea devuelto al Juzgado de Garantías 1 de Orán para que se continúe con el estado procesal en el que estaba la causa antes de la presentación.
El acusado, en tanto, continuará privado de su libertad. Había sido denunciado el 23 de enero de este año.
